Can a landlord charge for a security deposit in PA? This limit changes based on the length of tenancy. It must be returned within days after the end of the lease.


For every year after the first year, a deposit equal to one month`s rent is all that may be required. Any security deposit greater than $ 1held by a landlord must be placed in a bank in escrow. The Landlord Tenant Act requires that interest be paid on security deposits held over two years.

The security deposit must, however, be greater than $1or this part of the law does not apply. For security deposits over $ 1, landlords must deposit the funds in a federally or state-regulated institution. A security deposit is not the same as rent. If the landlord does not follow the exact letter of the law their right to withhold ANY of your deposit money is forfeited completely. Upon signing the agreement a security deposit is usually provided by the tenant.


Under the act, a landlord doesn’t have the right to forbid overnight guests or to limit the number of visitors a tenant has in a week or month. Many states have limits on how much a landlord can charge for a security deposit. On average, regular deposits are around one to two months rent, depending on the property and prospective renters qualification criteria.

We are vacating our apartment and are afraid our landlord may try to hold our security deposit for our share of the heating oil. The renter pays the rent according to these terms set in the rental agreement. Security deposits are not a part of the monthly rent.
