If you continue to collect monthly rent from the tenant and allow them to stay in the unit, you won’t be able to evict them later based on holdover. Treat the tenant as a trespasser and evict them. You can usually evict a tenant for non-payment of rent, or criminal behavior like drugs or domestic violence. And the time specified can range from three days to days or even more. It depends, once again, on the cause for the eviction, your circumstances and the applicable laws.
In no-cause states, where a landlord can boot out a tenant at will, he is still required to give ample notice. The eviction process can take anywhere from two weeks to several months , depending on where you live.
Once the landlord has obtained an eviction order from the court, you typically have around five days to move out. Basically, it can take a few weeks or even months to fully move through the eviction process depending on the situation. If the Court Orders You Out. I did not pay jan rent and they served me with an eviction summons on the 28th which I did not have the money to file a responce and have it served in time as the feb 2cd would have been it.
