What is Tenant Advice Service? Do you have rights as a tenant? Do tenants have a right to a written tenancy agreement? The legislative rights and responsibilities of tenants and landlords are outlined in the Residential Tenancies Act. This law applies to people who live in private and public housing rentals.


The law does not apply to people who rent holiday accommodation, pay no rent, live in charitable accommodation or accommodation in a Caravan Park.

Some confine their advice just to homelessness problems, but others provide advice on other tenant related issues too. The local authority housing advice section, if there is one, may also be able to supply sample tenancy agreements. Your agreement might say you have a certain type of tenancy - but the type of tenancy you actually have might be different. The tenancy you have depends on the facts of your situation, not what your agreement says.


It is possible to make a claim yourself through the Housing Ombudsman Service. Tenants Advice and Advocacy Services provide free assistance to tenants of private rental housing, social housing tenants , boarders and lodgers, and residential park residents in NSW.
